The DPA (Dating Pool App) provides access to a service and moderates those who choose to participate in that service. Below are the main points that we want you to know that are gone over in detail throughout this document. You will be required to check a box saying you have read and understood this entire document and agreed to it before you purchase your subscription:

We are a small business acting in good faith with good intentions. If you have an issue with how we handled a certain situation please contact us through email so we can discuss the situation with you and hopefully come to an agreement that leaves both parties on good terms.

Terms and Conditions

These Terms and Conditions are between you, the individual (“Client”, “user”, “you”, “payee”, and “your”) and The DPA (“us”, “our”, “ourselves”, “we”, “The Company”). "Party", or "Parties", refers to both the Client and Ourselves. The Terms and Conditions outline the rules and regulations for the access and use of our websites (the “Website” for each individual website, or “Websites” collectively);

including each Website's mobile and web versions; along with the downloaded and use of any of The DPA's applications (including Android, iOS, and Online/Web applications [the “Application” for each individual application, or “Applications” collectively]); and registration to, or use of, any of the services provided by us through the mentioned platforms above (the Websites and Applications each a “Service” or collectively “Services”)

By using any of the Services, you agree to these terms and conditions, including the Privacy Policy, for as long as you continue to use the Services. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT USE ANY OF THE WEBSITES, APPLICATIONS, OR SERVICES.

The Terms and Conditions are subject to change by us, at our sole discretion, at any point in time. This page will contain the most updated version of the Terms and Conditions. Your continued use of the Websites, Applications, and Services constitutes your acceptance of the updated Terms and Conditions with the revisions made to it.

1. Subscriptions

1.1. Requirements. You must be at least 18 years old to purchase or use any of our Services.

1.2. Duration. Subscriptions are only offered in 183-day durations (about 6 months). When referencing time and dates, we use the Gregorian Calendar and the UTC zone. There are no monthly, quarterly, or yearly subscription options. The subscription you purchase will last 183 days from the date of purchase. Example; if you purchased your subscription at 21:00 UTC on October 13th, 2024, your subscription would end on April 11th, 2025 at 23:59 UTC.

1.3. Payment Methods. Payment Methods. We accept multiple payment methods along with multiple currencies. There are certain fees associated with each type of payment method and currency which is explained in Section 1.4. We also do not offer, or participate in, automatic renewal which is explained in Section 1.5.

Your account will be created when the payment is successfully processed and captured. This can take up to three business days depending on the payment method and time of order. This possible delay can be unexpected and does not permit the extension of the expiration date. (Please view our FAQ page for a more detailed explanation.) You will be notified by email when your account is created.

If for any reason the payment is disputed, no matter the outcome of the dispute, the status of the account will be void. This will deem the account terminated, and unusable.

1.4. Fees. We classify fees as additional costs that are added to the original price of the Service. Two different fees may occur; Taxes and Currency Conversion.

a. Taxes. Depending on the payment method used, if the payment information provides a location we may collect Sale-Tax/VAT/GST. These taxes will be in addition to the advertised prices on the websites and apps.

b. Currency Conversion. The DPA deals in USD when it comes to currency. Depending on the location entered, the IP Address, or the payment method of your choice; you may be offered an automated rate for currency conversion. There will be an additional fee to help with the exchange rate and processing fees.

1.5. Renewal. You must manually renew your subscription. There is no option to automatically renew your subscription.You can renew your subscription at any point in time. If the subscription is renewed, another 183 days are added to the expiration date.
Example; Your expiration date is March 31th 2025. If renewed, the new expiration date would be September 30th, 2025 at 23:59 UTC.

To avoid a pause in service, subscription renewal needs to be submitted to allow for three full business days before the expiration date.
Example: The expiration date is Sunday, July 14th, 2024. The purchase to renew the subscription would need to be placed on Tuesday the 9th. That allows for three full business days (Wednesday, Thursday, and Friday [Saturday and Sunday are not considered business days]) for the payment to process and for the subscription to be updated.

1.6. Cancellation. Since we do not automatically renew your subscription, your subscription will be canceled on the expiration date if it is not manually renewed. If you wish to cancel your subscription before the expiration date, you can delete your account which is explained in Section 1.8. If you cancel a subscription, you understand and agree that you will not receive a refund. Please refer to Section 1.7 for refunds. Once an account is canceled and the subscription has expired for at least seven days, the account will be “deleted”, Section 1.8.

1.7. Refunds. We address refund requests on a case-by-case basis, and we reserve the right to allow or deny the request based on the information provided for the request. Adequate information has been provided to allow you, the Client, multiple opportunities to make an informed decision about your purchase, including but not limited to; a demo application to familiarize yourself with the service, informative content on our website, and acknowledgment of accepting this very document before purchasing your subscription.

1.8. Account Deletion. An account is never completely deleted, it is removed from all data and marked as void which is why we refer to it as “deleted”. If you wish to “delete” your account, this can only be done on the app. Again, when you “delete” your account, your account will be marked as void and all the data you submitted and created will be deleted. All information about financial transactions between you and The DPA is kept and maintained and will not be deleted. The account cannot be renewed after 14-days of the subscription being expired and a new account cannot be created with the email that was used. Please view the Privacy Policy for that information. If you desire an explanation, please view our FAQ page on the website.
How to delete your account: When on the home page of the app, select “Data” > scroll to the bottom of the Data page and select “DELETE”. You will be prompted to confirm your decision. If you are positive you want to delete your account, select “DELETE”.

1.9. Changes to Price and Plans. We maintain the ability to change our subscription plans and the price of those plans however and whenever we choose to do so without any requirement of notification to users or the public. Any changes that take place will only affect those who have not already paid for their subscription.
Example: if the subscription price is increased from $36 to $40, only members who are either renewing their subscription or creating a new account will pay the new price of $40. If you renewed your subscription the day prior at $36 and your previous subscription does not expire for another month, you will remain unaffected since you already paid for the renewed subscription.

a. Pro-rated Rates:

- Economy Subscription: Value#1 = .056 _ Value#2 = .082
- Local Subscription: Value#1 = .143 _ Value#2 = .196
- National Subscription: Value#1 = .179 _ Value#2 = .246
- Worldwide Subscription: Value#1 = .367 _ Value#2 = .491
- Worldwide Plus Subscription: Value#1 = .690 _ Value#2 = .918

b. Account Upgrade - accounts can only be upgraded when a subscription is being renewed. When you choose to renew and upgrade your subscription, the remaining number of days of your current subscription will be multiplied by the pro-rated Value#1 of your current subscription level and then divided by the pro-rated Value#2 of the new subscription level. This will then be added to the 183 days of the new subscription which takes effect after the payment has been completed.

Example: In this example, the date is May 5th and you want to renew your subscription. You have a Nation subscription with an expiration date of May 25th. You decide you want to upgrade to a Worldwide subscription. If you renew your subscription and upgrade it to a Worldwide subscription, this is how the price will be calculated:

May 25th minus May 5th = 20 days left of the current subscription.
Value#1 of current subscription level (National) = .179
Value#2 of new subscription level (Worldwide) = .491
Pro-Rated Days _ 7 = (20*.179)/.491
Total Length of new subscription _ 190 days = (183 days + 7 Pro-Rated days)
The new expiration date is November 11th (last day of service)

c. Account Downgrade - accounts can only be downgraded when a subscription is being renewed. It is the same formula as above.

Example: Same example from above but you have a Worldwide subscription and want to downgrade to a National subscription.

May 25th minus May 5th = 20 days left of the current subscription.
Value#1 of current subscription level (Worldwide) = .367
Value#2 of new subscription level (National) = .246
Pro-Rated Days _ 30 = (20*.367)/.246
Total Length of new subscription _ 213 days = (183 days + 30 Pro-Rated days)
The new expiration date is December 4th (last day of service)

2. The DPA Service

2.1. The DPA and any content accessed through our services are for your personal, non-commercial use only. During the length of your subscription plan, we grant you a limited, non-exclusive, non-transferable right to access The DPA Service.

2.2. You agree to use The DPA Services in accordance with all applicable laws, rules, and regulations, or other restrictions on the use of the service except as explicitly authorized by us.

In short: You agree not to copy or modify our work in any way, and that you will act in good faith towards us and what we provide.

In long legal form, you agree not to:

a. Distribute, license, reproduce, publish, offer for sale, or re-engineer the works from the content and information contained on, or obtained from, or through, The DPA Services.

b. Alter, block, circumvent, degrade, deactivate, obscure, or remove any of the content or system protections including the graphical user interface, copyright notices, and trademarks.

c. Use any data extraction, mining, or gathering methods; use any automated means to access The DPA Service; or decompile any software provided by The DPA.

d. Insert any code and/or manipulate the content of The DPA Service.

e. Send or transmit any material or data not desired or requested to our servers that may interrupt, limit, or destroy the functionality of any hardware or software associated with The DPA Service.

Any user caught violating these Terms and Conditions will have their account terminated.

2.3. You agree to act in good faith and provide correct information when submitting data and content.

a. Account data submitted will be current and truthful.

b. All images posted to your account must include you in them. All images submitted should be considered publicly appropriate. If you would not be seen in public as you are pictured in the image, or the public/society would not deem it appropriate, then it is not acceptable to submit that image for your account.
Listed below are reasons for reporting images that should not be posted on The DPA Service.

  1. Pictures of individuals under the age of 18 years old are not acceptable.
  2. AI or Animated Characters are not acceptable. This includes any AI-generated image or animated/cartoon-style character.
  3. Nudity is not tolerated. Nudity includes but is not limited to; content showing, or engaging in sexual intercourse; genitals; fully nude buttocks; or unclothed individuals.
  4. Marketing content is not tolerated. Marketing content includes but is not limited to; advertisement for a brand, product, or service; or product placement.
  5. Low-quality images. Low-quality images are images that appear pixelated and/or may have an unrecognizable person in the image.
  6. Spam/Phishing Images. Images that do not seem correct; normally a lower quality image; and/or a stock photo that represents a different individual.

Any image that has been reported to have violated these rules will be reviewed by The DPA Admin and action will be taken at our sole discretion depending on the severity. If a user does not blatantly ignore the rules, then we will likely give a warning to the user. If the rules are completely ignored and/or an image is blatantly unacceptable the account will be terminated.

c. When participating in the judging process, you agree to provide honest judgment and report any images that violate the rules in 2.3.b. or for another reason that you deem necessary to report.

2.4. The DPA software may vary by device and version. By using our Web application, you agree to receive the most up-to-date version of the app. For downloaded mobile apps, you will have the choice to update that software.

3. Account

3.1. Your account will only be accessible via the server you selected.
Example: if you selected the server in North America, you can only sign in and access your account via the apps hosted on the server in North America.

3.2. You understand that access to your account is maintained through the email address you provided when purchasing the subscription. The email address provided can not be changed.

3.3. You are responsible for any activity that occurs on your account.

3.4. Your ability to participate in The DPA Service may be temporarily suspended if your account is reported by another user. We review all the reports and determine the penalties at our sole discretion. If a report is justified, the user being reported will be penalized for not following these Terms and Conditions. Punishment can vary from a warning to termination. If the report is malicious and/or blatantly untrue, the user who submitted the report will be recorded. If that same user is found to have submitted multiple malicious/untrue reports, their account will be terminated.

Below are the reasons, actions needed, and possible outcomes when it comes to being reported;

a. Image(s) Reported - A single image or your image gallery may have been reported.

  1. A single image would have to be reported three separate times by three different users for your account to be suspended. Your account will remain suspended until the image is replaced.
  2. Your image gallery was reported to not have the same individual in all the photos. As stated in section 2.3.b., “All images posted to your account must include you in them”. This is something that we prioritize and will review. This is one of the main ways accounts are verified.

  3. - If the situation is ambiguous where only one image may be in question, we will give you the benefit of the doubt that it was an accident. We will delete that image and reactivate your account. Make sure that ALL your images clearly have you in them. If you are reported again, we will review it again and if the report is justified your account will be terminated.

    - If there are two or more images that do not match a single individual, your account will be terminated.

b. Account Reported - This is when a user that you matched with reported you. Reasons for reporting a match are;

  1. Inaccurate Account Information - When account details and/or information are not correct. This is another situation that we take seriously because this is rarely done by accident. This is something we will review.

    - We will give you the benefit of the doubt if it happens to be a single piece of information or detail. If we deem it plausible to be an accident, we will delete that specific detail. Once you add the correct details your account will be reactivated. Make sure ALL your account data is correct. If you are reported again, we will review it again and if the report is justified your account will be terminated.

    - If multiple pieces of information or details are obviously incorrect, your account will be terminated.
  2. Unsolicited Inappropriate Messages - Messages that were perceived as offensive, threatening, and/or unacceptable by the user that received those messages that were sent by you. With messages being encrypted, we are not able to read those messages. With the first reported issue, we will give you the benefit of the doubt. If there is a second report in a six-month period your account will be terminated.
  3. Spam/Phishing - When an account's actions are fraudulent, the account is not using The DPA Service as it was intended to be used. This is something we will review. We will look over your account profile. We always try to give users the benefit of the doubt. If there are things in question we may notify you to clarify or make the changes needed. If we agree that this account is fraudulent, or there are multiple instances of the account being reported as Spam/Phishing, the account will be terminated.
  4. Other - A reason deemed necessary to report that must be explained in detail. This is something we will review. We will give the user the benefit of the doubt. If there are multiple instances of the account being reported, the account will be terminated.
    If your account has a total of three suspensions in a six-month period, your account will be automatically terminated.

3.5. If your account was temporarily suspended due to a false report that made you miss the weekly drawing, we may choose to extend your account expiration date or give you an extra token to a pool to accommodate you for the drawing missed.

4. Disclaimers, Limitations, & Waiver of Liability

4.1. The DPA, along with all its content, software, features, and functionalities, is offered "as is" and "as available," complete with any inherent flaws, and without any warranties. The DPA does not assure, represent, or guarantee that your utilization of The DPA will be free from interruptions or errors. The DPA explicitly disclaims any responsibility for the utilization of applications and The DPA software.

4.2. To the maximum extent permitted by applicable laws; The DPA; its subsidiaries; and any of their shareholders, directors, officers, employees, or licensors; shall not be held liable, either jointly or severally.

4.3. There are no guarantees of receiving a match with another user. With our Services, you are given a great amount of freedom when it comes to your ability to adjust your search for another user. This is great for fine-tuning exactly what you want, but can also greatly decrease your odds of finding a match.

4.4. By accessing or using The DPA's services, you agree to waive any and all claims, causes of action, or demands against The DPA, its affiliates, officers, employees, and representatives, arising out of or related to any damages, losses, or harm suffered as a result of data breaches, unauthorized access, or compromise of user accounts.

You acknowledge and agree that The DPA shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury or any form of special, incidental, indirect, or consequential damages, intangible losses, or for any damages whatsoever, incurred by you.

Furthermore, you expressly waive any right to pursue legal action, arbitration, or any other dispute resolution mechanism against The DPA in connection with such damages, losses, or harm.

This waiver of liability shall apply to the fullest extent permitted by law, regardless of the legal theory or cause of action asserted.

5. Miscellaneous

5.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Florida, United States of America without regard to conflict of laws provisions.

5.2. If any provision or provisions of these Terms and Conditions shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.
